S. Korean court uses video technology to question remote witnesses

SEOUL, Nov. 16 (Yonhap) — A Seoul court on Wednesday used video cameras to question a witness on the country’s resort island of Jeju, as it attempts to cut the social and economic costs spent on summoning people living far away from courthouses.

The hearing held at the Seoul Central District Court was the first case to take advantage of the revised Civil Procedure Act that permits the remote interrogation of witnesses via video feed. The changes went into effect in September.

During the trial, the legal representatives of the plaintiff and the defendant sat side by side in front of their laptops equipped with cameras, instead of facing each other.

A huge screen hanging on one side of the courtroom showed the witness who was present at the Jeju District Court and accompanied by a court official. The screen was divided into three parts to also show both of the legal representatives present at the trial in the capital city.

The procedure began, just like any other hearing, with the judge ordering the witness to take an oath, and ended after an hour without any major disruption.

According to the court, witnesses or experts who cannot attend a hearing due to geographical or traffic reasons can apply to use the system, though the judiciary has the final say on whether to approve the decision.

“There have been many cases where questioning witnesses at court was difficult due to health or livelihood issues,” a court official said.

“We hope this new system will contribute to improving the examination of evidence and enhance efficiency and to cut the social and economic costs spent on questioning remote witnesses,” he said.

Court officials hold a mock trial to test remote interrogation via video cameras at the Seoul Central District Court in southern Seoul on Nov. 9, 2016. The court questioned a witness living on the country’s resort island of Jeju on Nov. 16, 2016, marking the first time for a local court to use such technology since the Civil Procedure Act was revised in September.
